FAMILY EDUCATIONAL RIGHTS AND PRIVACY ACT (FERPA)

NOTICE REGARDING ACCESS TO STUDENT RECORDS AND STUDENT INFORMATION

The Family Educational Rights and Privacy Act (FERPA) affords parents and

students who are 18 years of age or older ("eligible students") certain rights

with respect to the student's education records. These rights are:

  1. The right to inspect and review the student's education records within 45

days after the day the Walton Central School District (“School”) receives a

request for access.

Parents or eligible students who wish to inspect their child’s or their

education records should submit to the Building Principal a written request that

identifies the records they wish to inspect. The school official will make

arrangements for access and notify the parent or eligible student of the time

and place where the records may be inspected.

  1. The right to request the amendment of the student’s education records that

the parent or eligible student believes are inaccurate, misleading, or otherwise

in violation of the student’s privacy rights under FERPA.

Parents or eligible students who wish to ask the Walton Central School District

to amend their child’s or their education record should write the Building

Principal, clearly identify the part of the record they want changed, and

specify why it should be changed. If the school decides not to amend the record

as requested by the parent or eligible student, the school will notify the

parent or eligible student of the decision and of their right to a hearing

regarding the request for amendment. Additional information regarding the

hearing procedures will be provided to the parent or eligible student when

notified of the right to a hearing.

  1. The right to provide written consent before the school discloses personally

identifiable information (PII) from the student's education records, except to

the extent that FERPA authorizes disclosure without consent.

One exception, which permits disclosure without consent, is disclosure to school

officials with legitimate educational interests. The criteria for determining

who constitutes a school official and what constitutes a legitimate educational

interest must be set forth in the school’s or school district’s annual

notification for FERPA rights. A school official typically includes a person

employed by the school or school district as an administrator, supervisor,

instructor, or support staff member (including health or medical staff and law

enforcement unit personnel) or a person serving on the school board. A school

official also may include a volunteer, contractor, or consultant who, while not

employed by the school, performs an institutional service or function for which

the school would otherwise use its own employees and who is under the direct

control of the school with respect to the use and maintenance of PII from

education records, such as an attorney, auditor, medical consultant, or

therapist; a parent or student volunteering to serve on an official committee,

such as a disciplinary or grievance committee; or a parent, student, or other

volunteer assisting another school official in performing his or her tasks. A

school official typically has a legitimate educational interest if the official

needs to review an education record in order to fulfill his or her professional

responsibility.

Upon request, the school discloses education records without consent to

officials of another school or school district in which a student seeks or

intends to enroll, or is already enrolled if the disclosure is for purposes of

the student’s enrollment or transfer.

For a complete list of exceptions to FERPA’s prior consent requirements, please

speak with the District Office.

  1. The right to file a complaint with the U.S. Department of Education

concerning alleged failures by the Walton Central School District to comply with

NOTIFICATION OF DIRECTORY INFORMATION DESIGNATIONS

In addition to the rights outlined above, FERPA also gives the school district

the option of designating certain categories of student information as

“directory information.” Directory information includes student:

  • Name
  • Address (except information about a homeless student’s living situation, as

described below)

  • Telephone number
  • Date of birth
  • Participation in school activities or sports
  • Weight and height if a member of an athletic team
  • Dates of attendance
  • Degrees and awards received
  • Most recent school attended
  • Class Designation/Grade level
  • Digital images and video with or without name (use Media Release Form to

opt-out)

  • E-mail address (school)
  • Enrollment status

Information about a homeless student’s living situation shall be treated as a

student educational record, and shall not be deemed directory information.

In addition, Federal law requires the District to provide military recruiters,

upon request, with names, addresses, email addresses and telephone listings of

students in 11 th grade or above, or those 17 years of age or older, unless

parents opt out of such disclosures.

You may object to the release of any or all of this “directory information.”

However, you must do so in writing to the Superintendent of Schools within 14

days of receiving this notice. If we do not receive a written objection, the

District will assume that you give permission for your child(ren)’s directory

information to be publicly disclosed, and we will be authorized to release this

information without your consent. Please note that this request must be made

every year.

SECTION 504 ANNUAL NOTICE

In accordance with the Rehabilitation Act of 1973, commonly known as Section

504, the Walton Central School District hereby notifies disabled children and

their parents of the Walton Central School District duty under the Regulations

to Section 504.

The Walton Central School District shall provide a free appropriate public

education to each qualified disabled child who resides in the Walton Central

School District regardless of the nature or severity of the disability. The

Walton Central School District shall educate each qualified disabled child with

children who are not disabled to the maximum extent appropriate to the needs of

the disabled child, and shall also ensure that disabled children participate

with non-disabled children in nonacademic and extra-curricular activities to the

maximum extent appropriate. A disabled child shall be afforded an equal

opportunity for participation in such services and activities.

The Walton Central School District shall provide disabled children an equal

opportunity for participation in physical education courses, interscholastic,

club or intramural athletics.

The Walton Central School District shall conduct preplacement evaluations, and

shall establish standards and procedures consistent with Section 104.35 for the

evaluation and placement of children who need or are believed to need special

education or related services. Periodic reevaluation shall be conducted of

children who have been provided special education or related services.

Placement decisions shall draw upon information from a variety of sources and

shall be made by a group of persons knowledgeable about the child, the meaning

of the evaluation data, and the placement options. The Walton Central School

District shall establish and implement a system of procedural safeguards that

includes notice, an opportunity for the parent to examine relevant records, an

impartial hearing with the opportunity for participation by the parent and

representation by counsel, and a review procedure.

RIGHTS UNDER THE PROTECTION OF PUPIL RIGHTS AMENDMENT (PPRA)

PPRA affords parents of elementary and secondary students certain rights

regarding the conduct of surveys, collection and use of information for

marketing purposes, and certain physical exams. These include, but are not

limited to, the right to:

  • Consent before students are required to submit to a survey that concerns one

or more of the following protected areas (“protected information survey”) if the

survey is funded in whole or in part by a program of the U.S. Department of

Education (ED)–

  1. Political affiliations or beliefs of the student or student’s parent;
  1. Mental or psychological problems of the student or student’s family;
  1. Sex behavior or attitudes;
  1. Illegal, anti-social, self-incriminating, or demeaning behavior;
  1. Critical appraisals of others with whom respondents have close family

relationships;

  1. Legally recognized privileged relationships, such as with lawyers, doctors,

or ministers;

  1. Religious practices, affiliations, or beliefs of the student or student’s

parent/guardian; or

  1. Income, other than as required by law to determine program eligibility for

participation in a program or for receiving financial assistance under such

program).

  • Receive notice and an opportunity to opt a student out of –
  1. Any other protected information survey, regardless of funding;
  1. Any non-emergency, invasive physical exam or screening required as a

condition of attendance, administered by the school or its agent, and not

necessary to protect the immediate health and safety of a student, except for

hearing, vision, or scoliosis screenings, or any physical exam or screening

permitted or required under State law; and

  1. Activities involving collection, disclosure, or use of personal information

collected from students for marketing or to sell or otherwise distribute the

information to others. (This does not apply to the collection, disclosure, or

use of personal information collected from students for the exclusive purpose of

developing, evaluating, or providing educational products or services for, or

to, students or educational institutions.)

  • Inspect , upon request and before administration or use –
  1. Protected information surveys of students and surveys created by a third

party;

  1. Instruments used to collect personal information from students for any of the

above marketing, sales, or other distribution purposes; and

  1. Instructional material used as part of the educational curriculum.

These rights transfer from the parents to a student who is 18 years old or an

emancipated minor under State law.

The Walton Central School District has developed and adopted policies regarding

these rights, as well as arrangements to protect student privacy in the

administration of protected information surveys and the collection, disclosure,

or use of personal information for marketing, sales, or other distribution

purposes. The Walton Central School District will directly notify parents of

these policies at least annually at the start of each school year and after any

substantive changes. The Walton Central School District will also directly

notify, such as through U.S. Mail or email, parents of students who are

scheduled to participate in the specific activities or surveys noted below and

will provide an opportunity for the parent to opt his or her child out of

participation of the specific activity or survey. The Walton Central School

District will make this notification to parents at the beginning of the school

year if the District has identified the specific or approximate dates of the

activities or surveys at that time. For surveys and activities scheduled after

the school year starts, parents will be provided reasonable notification of the

planned activities and surveys listed below and be provided an opportunity to

opt their child out of such activities and surveys. Parents will also be

provided an opportunity to review any pertinent surveys. Following is a list of

the specific activities and surveys covered under this direct notification

requirement:

 * Collection, disclosure, or use of personal information collected from

   students for marketing, sales, or other distribution.

 * Administration of any protected information survey not funded in whole or in

   part by ED.

 * Any non-emergency, invasive physical examination or screening as described

   above.

payment of professional fees and all other necessary costs incidental to such

work (collectively, “Project I”) and expend therefore a total sum not to exceed

$22,750,000, which is estimated to be the total maximum cost thereof, and to pay

for Project I by spending $1,780,700 together with any unexpended interest

earnings on deposit in the Capital Reserve Fund approved by the District’s

voters in May of 2019 and then terminate such fund, and the levy of a tax which

is hereby voted in the amount of $20,969,300, subject to available State aid or

to any other revenues available for such purpose, which tax shall be levied and

collected in annual installments in such years and in such amounts as may be

determined by the Board of Education and in anticipation of the collection of

such tax, bonds and notes of the District are hereby authorized to be issued at

one time, or from time to time, in the principal amount not to exceed

$20,969,300, and a tax is hereby voted to pay the principal and interest on said

obligations when due.

CAPITAL PROJECT PROPOSITION II

Only if Capital Project Proposition I is approved by the voters, shall the

following resolution be adopted:

RESOLVED, that the Walton Central School District is hereby authorized to

undertake a capital improvement project consisting of construction of a new

front loop drop-off area at the Townsend Elementary Building and the site

thereof, the purchase of original furnishings, equipment, machinery and

apparatus required in connection with the purposes for which such buildings,

facilities and sites are used, all to include site, access, parking, demolition,

utility, mechanical, plumbing and electrical improvements as well as payment of

professional fees and all other necessary costs incidental to such work

(collectively, “Project II”) and expend therefore a total sum not to exceed

$1,332,000 which is estimated to be the total maximum cost thereof, and to pay

for Project II by the levy of a tax which is hereby voted in the amount of

NOTICE OF PUBLIC HEARING

VILLAGE OF UNADILLA

Village of Unadilla will hold a public hearing on September 15th, 2026, at 6:00

pm at 77 Clifton Street Unadilla, NY 13849, Unadilla, NY 13849 for the purpose

of hearing public comments on the Village of Unadilla’s community development

needs, and to discuss the possible submission of one or more Community

Development Block Grant (CDBG) applications for the current 2026 program year.

The CDBG program is administered by the New York State Office of Community

Renewal (OCR) and will make available to eligible local governments

approximately $45 million for the 2026 program year for housing, economic

development, public facilities, public infrastructure, imminent threat and

community planning activities, with the principal purpose of benefitting

low/moderate income persons. Village of Unadilla is applying up to $750,000 in

CDBG funds to undertake housing rehabilitation for owner-occupied single-family

homes. The hearing will provide further information about the CDBG program,

including progress towards beneficiary goals and program objectives, and will

allow for citizen participation in the development of any proposed grant

applications and/or to provide technical assistance to develop alternate

proposals. Comments on the CDBG program or proposed project(s) will be received

at this time. The hearing is being conducted pursuant to Section 570.486,

Subpart I of the CFR and in compliance with the requirements of the Housing and

Community Development Act of 1974, as amended.

The location of hearing is accessible to persons with disabilities. If special
