The New York State Department of Environmental Conservation (DEC) has finalized updated regulations under the Freshwater Wetlands Act, safeguarding an additional one million acres of wetlands statewide. The rules, effective January 2025, aim to enhance flood mitigation, water quality, and biodiversity while balancing environmental protection with economic development.
DEC Interim Commissioner Sean Mahar highlighted the vital role wetlands play in protecting communities and ecosystems, praising the regulations as a critical step forward. The updates clarify protections for smaller wetlands of “unusual importance” and streamline public processes for wetland determinations.
Environmental groups, including the Sierra Club, Audubon Society, and The Nature Conservancy, hailed the reforms as essential for combating climate change and protecting New York’s biodiversity and infrastructure.
The DEC will host an informational webinar on Jan. 15 to explain the changes. Public comments on a proposed general permit for certain wetland activities are open through Jan. 27 via email to DEPPermitting@dec.ny.gov or via mail to NYSDEC Division of Environmental Permits, Attn: Kristen Cady-Poulin, 4th Floor, NYSDEC 625 Broadway, Albany NY 12233-1750. DEC is also developing additional draft freshwater wetland general permits in 2025.
