Former Delaware Academy teacher indicted

DELHI - Benjamin W. Moyse, 45, of Delhi, was indicted by the Delaware County Grand Jury Aug. 4 and charged with third-degree criminal facilitation, a felony, two counts of official misconduct, three counts of failure to report child abuse or maltreatment, and five counts of endangering the welfare of a child.

The charges stem from allegations that Moyse intentionally aided a person under the age of 16 in committing a felony of dissemination child pornography and failed to follow Delaware Academy’s policy or take action when students and teachers reported to him that students were being sexually abused.

Incidents of student ”sexting” that fueled the criminal charges began Aug. 3, 2020 and continued through Nov. 28, 2022, Acting District Attorney Shawn Smith said.

Moyse is scheduled to answer the charges in Delaware County Court Aug. 21 at 9 a.m.

Albany lawyer Kevin O’Brien, who represents Moyse, said of the indictment, “We are confident that when everything is said and done Ben will be exonerated. I’m also hopeful we will be able to show what a bunch of hypocrites Delhi school officials are.”
