The U.S. Department of Homeland Security-Federal Emergency Management Agency (DHS-FEMA) proposes to provide funding to the New York State Division of Homeland Security and Emergency Services (DHSES), as recipient, and the Village of Sidney, as sub-recipient, as part of the Sidney Water System Improvements Project. The project involves decommissioning the Peckham Dam; locating, acquiring and designing a new ground water drinking source; and replacing water mains under the Susquehanna and Unadilla Rivers to ensure water supply remains reliable for all areas. FEMA funding will be provided through FEMA’s Public Assistance Program, in accordance with the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1974 (42 U.S.C. 5172), as amended.
This public notice is issued as part of DHS-FEMA’s responsibilities under 36 C.F.R. Part 800, the regulations which implement Section 106 of the National Historic Preservation Act (NHPA) of 1966, as amended, 16 U.S.C.¤ 470. FEMA, as Lead Federal agency, is required by regulation to identify and assess the effects of any proposed actions on historic properties. If any proposed Undertaking will have an adverse effect on historic resources, FEMA works with the appropriate parties to seek ways to avoid and minimize or mitigate any adverse effects. Additionally, the Section 106 regulations require FEMA to consider the views of the public on preservation issues when making final decisions that affect historic properties.
The Village of Sidney proposes to eliminate potential danger to homes located downstream of the Peckham Reservoir Dam, and to ensure long term operation and full function of the village water supply system. This includes 1) breaching the Peckham Dam earthen embankment, 2) replacing the Susquehanna and Unadilla river crossings with new high-density polyethylene pipe to be installed by directional drilling methods, and 3) the provision of a back-up water supply.
The Lords/Wells Native American Site has been determined eligible for the National Register of Historic Places by the New York State Historic Preservation Office under Criterion D for its ability to yield information important in prehistory as intact representation of a Late Woodland Period site that can contribute information on settlement and subsistence as well as land-use patterns in the Upper Susquehanna River Valley (NYSHPO Ref. No.: 02540.000001). NYSHPO, in a letter dated November 27, 2019, determined that construction of the Susquehanna River Crossing would be an Adverse Effect to Historic Properties.
This notice is seeking public input and comments on this project reflecting any knowledge of, or concerns with, historic properties in the proposed project area. The comment period for the proposed Undertaking detailed above will end 15 days from the date of this legal notice publication in Tri-Town newspaper. Written comments on the proposed adverse effects can be mailed to DHS-FEMA Region II, Office of Environmental Planning & Historic Preservation, Leo O’Brien Building 11A Clinton Avenue, Suite 600, Albany New York 12207 or via email at FEMAR2COMMENT@fema.dhs.gov. If no substantive comments are received, FEMA will move forward with the Section 106 Adverse Effect process.

Invitation to Bid
The Town of Franklin is seeking bids for the crushing of 5000 cubic yards (c/y) of 1.25” (minus) gravel in the Town’s gravel pit. With “Board” approval additional quantities of 2500 Ð 5000 c/y will be considered for processing. This will be contingent on price and time restraints.
Contractor will provide crusher and manpower to operate crusher.
Contractor will provide loader to feed the crusher and carry product to stock pile.
Contractor to provide Bulldozer for pushing off top layer of gravel before processing.
Contractor will pre-screen all material to ½ inch minus to remove fines before crushing.
Crushed material will be piled in a square or rectangle dimension for measuring.
All material will be “bid” and measured by the cubic yard, not w/bucket scales.
Crushed material: First 5000 c/y will be completed by May 28, 2020 (Weather Permitting). Additional time frame for additional quantity’s to be worked out with Vendor and Superintendent.
Finished product will be the cost of crushing.
All contractors will conform to MSHA Federal Mine Safety and Health Regulations.
All sealed bids must be received before: Tuesday Ð April 7, 2020 @ 2:30pm.
All sealed bids will be opened at the Town Office Building April 7, 2020 @ 7:30pm.
“No” Internet Bids will be accepted.
The Town Board reserves the right to reject any/or all bids.
