EPF-LWRP FUNDED
PROJECT
The Municipality seeks
to expand the Delhi River
Park & Walk - P-2 project,
comprised of new paved
park entry trail, parking and
basketball court improvements, stormwater retrofits,
signs and amenities, for
which landscape architectural and engineering design has been completed.
This project is being fi-
nanced with an Environmental Protection Fund
Local Waterfront Revitalization Program (“EPF-LWRP”)
grant administered by the
NYS Department of State
(“NYS DOS”), which will be
matched with funding from
the NYC Department of
Environmental Protection
(“DEP”) Stormwater Retrofit and Stormwater Futures Grants administered
through the Catskill Watershed Corporation (“CWC”),
the Delaware County Soil &
Water Conservation District
(“DCSWCD”) SMIP funding, and the Village of Delhi.
Attention of bidders is particularly called to Section
3 requirements, M/WBE
goals, Federal labor standards, Federal and State
prevailing wage rates, online reporting requirements
using NYS Contracts System and other requirements
included in the Supplementary Conditions for Contracts. See Instructions to

CONSOLIDATION PLAN
FOR WALTON FIRE
PROTECTION DISTRICT
Under Article 17-A of the
New York General Municipal Law, also called
the “New N.Y. Government
Reorganization and Citizen Empowerment Act,” a
Town Board may initiate the
consolidation of, among
other entities, special districts. At this time, the Town
of Hamden is seeking to
consolidate the Walton
Fire Protection District—a
special district within the
Town of Hamden for which
the Town contracts with the
Walton Fire Department for
fire protection services—
into Walton Fire District—a
separate municipal entity
governed by a Board of
Fire Commissioners. At the
conclusion of this consolidation action, all of the parcels involved in the transaction would be included in
the Walton Fire District.
In order to consolidate a
fire protection district into
a fire district, the Town of
Hamden is required to propose a Consolidation Plan.
Under NY GML § 751(2)(a),
this plan must specify:
• Name of local government entities to be consolidated: o Walton Fire Protection
District
o Walton Fire District
• Name of proposed consolidated government entity: o Walton Fire District
• Rights, duties and obligations of the proposed consolidated entity:
o Would be the same as
the existing Walton Fire District, whose territory would
simply have expanded to
include additional parcels.
• Territorial boundaries of
proposed consolidated entity: o See attached map for
current and proposed territorial boundaries.
• Type and/or class of the
proposed consolidated entity:

o Fire District
• Governmental organization of the proposed consolidated entity:
o The Walton Fire District
is governed, and would
continue to be governed,
by a Board of Fire Commissioners, elected in the
same manner, and on the
same schedule as currently
used by the Fire District.
o The only change resulting from this consolidation would be that residents
in the existing Walton Fire
Protection District would
be joined into the Walton
Fire District, and would
thereafter be eligible to
serve as Fire District Commissioners. • A fiscal estimate of the
cost and savings that may
be realized from consolidation: o Landowners in both
the Fire District and Fire
Protection District currently
pay for fire protection services through local property
taxes—the principal differences are how those taxes
are imposed and applied
to local tax bills. The Fire
District enacts a budget
which results in direct taxation of landowners on their
tax bills. The Fire Protection
District is provided service
via a contract executed
by the Town of Hamden
with the Walton Fire Department. The cost of that
fire protection contract is
passed on to the residents
in the Fire Protection District by the Town, based on
the cost of the contract, divided amongst the taxable
parcels within the Fire Protection District. The differences in these processes
may result in paying slightly
more or less for fire protection services depending
upon their location in the
Fire District of Fire Protection District. The change
proposed would result in all
landowners paying equally
for the same services.
o In some years, the
proposed change would
result in a savings to the
landowners in the Fire Protection District or Fire District, while other years the
proposed change may increase costs incrementally
for one or both groups.
o In 2018, Town of Hamden landowners located in
the Walton Fire District pay
a tax rate of $0.88037 per
$1,000 in assessed value.
o If the Fire Protection
District and Fire District
were consolidated, assuming no change in the Fire
District’s annual budget,
the tax rate for fire protection services in the newly
enlarged Fire District would
be approximately $0.8364
per $1,000 in assessed
value—a small decrease for
landowners currently in the
Fire District.
o Under the current Fire
Protection District Contract, which expires at the
end of 2018, the Town of
Hamden pays $10,000 for
fire protection services in
the Fire Protection District.
That $10,000 is divided
among the 191 properties
in the Fire Protection District, and those landowners
pay $3.28271 per $1,000 in
assessed value for fire protection services.
o Assuming the Fire District would need to increase
its budget by the $10,000
(the amount the Town of
Hamden currently pays the
Fire Department to provide
services to the Fire Protection District, which would
be eliminated during the
consolidation), the tax rate
for fire protection services
in the newly enlarged Fire
District would be approximately $0.8608 per $1,000
in newly assessed value—
still a small decrease for
landowners currently in the
Fire District.
• Each entity’s assets, including but not limited to
real and personal property:
o The proposed consolidation would not impact
the Fire District’s assets,
which would remain in the

District has no indebtedness, and its only liability consists of a contract
agreement with the Walton
Fire Department to provide
fire protection services,
which expires at the end of
2018. The intention would
be for the proposed consolidation to take effect
before or upon expiration
of the existing fire protection contract, which would
eliminate that contractual
obligation for future years.
• Terms for disposition of
existing assets, liabilities
and indebtedness:
o As noted, the Fire Protection District does not
hold assets, liabilities or
indebtedness which would
survive this consolidation,
or which would require disposition. • Enforcement of local
laws, ordinances, resolutions and orders:
o This section is not applicable to the Fire Protection District, which is an entity of the town and which
cannot adopt its own local
laws, ordinances, resolutions or orders. No such
enactments would be affected by the proposed
consolidation.
• Effective date of proposed consolidation:
o January 1, 2019

SEQRA DETERMINATION: The School District
improvements have been
determined to be an “Unlisted Action” pursuant to
the regulations of the New
York State Department of
Environmental Conservation promulgated pursuant
to the State Environmental
Quality Review Act (“SEQRA”), the implementation
of which as proposed, the
School District has determined will not result in any
adverse significant environmental impacts. A copy of
SEQRA compliance documentation is on file in the
office of the School District
Clerk where same may be
inspected during regular office hours.
ABSENTEE BALLOTS.

$277,923. The proceeds
from the sale of the obligations authorized in said
resolution shall be used
for the specific purpose
of financing the additional
cost of the replacement of

and St. John Street, which
streets will also be repaved, the replacement of
approximately 1,800 lineal
feet of watermain along a
portion of Prospect Avenue
(New York State Route 10),
the rehabilitation of the Village’s two water storage
tanks and the rehabilitation
of the Curry Well pumping facility. The estimated
maximum cost of said purpose is $2,000,000. The
remaining balance of the
cost of said purpose, that
being $1,722,077, shall
be financed as provided
in the prior bond resolution referred to above. The
Board of Trustees also
plans to apply to the New
York State Environmental
Facilities Corporation for
a grant through its Water
Grants program and for
funding through its Drinking Water State Revolving
Fund program to finance
or refinance a portion of
the cost of said purpose.

Water reserve funds and/or
Consolidated Local Street
and Highway Improvement
Program (CHIPS) funds
may also be used to pay a
portion of the cost of said
purpose. The period of
probable usefulness of said
purpose is forty (40) years.
